Contest Rules


NO PURCHASE IS NECESSARY TO ENTER OR WIN.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  THIS CONTEST IS NOT OPEN TO THE GENERAL PUBLIC. TO ENTER OR WIN, YOU MUST BE AN ELIGIBLE ENTRANT OR NOMINEE (EACH AS DEFINED BELOW).

Agreement to Official Rules.  Participation in the “Front Line Heroes Contest” (the “Contest”) constitutes Eligible Entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of BlueCross BlueShield of Arizona, an independent licensee of the Blue Cross and Blue Shield Association (“Sponsor”), which are final and binding in all aspects of this Contest.  The Contest is subject to all applicable federal, state, and local laws and regulations.  Void where prohibited.

Odds.  The odds of winning the Contest will depend on the number of eligible entries received and the contest winner will be selected based on skills, not at random. 

Eligibility.  The Contest is open only to individual entrants (each, an “Eligible Entrant’) and individual nominees (each, a “Nominee”) who are legal residents of, and physically located within, the State of Arizona and who are 18 years and older at time of entry. Directors, officers, and employees of Sponsor or its affiliates, or any other party associated with the development or administration of this Contest, including the immediate family and persons residing in the same household as such individuals, are not eligible to participate in the Contest.

Contest Period.  The Contest entry period will run from 10 a.m. Mountain Standard Time (“MST”) on November 9, 2020 until 5 p.m. MST on November 29, 2020 (the “Contest Period”).  Sponsor’s computer shall be the official time-keeping device for the Contest. 

How to Enter.  To enter the Contest, during the Contest Period, Eligible Entrant must (i) access azblue.com/heroes (the “Website”) and click on the “Submit Nomination” button; and (ii) complete and submit the official Contest entry form by filling in all required information, including (1) providing Eligible Entrant’s name, email address, phone number, and (2) providing the following information regarding Eligible Entrant’s Nominee (which may be Eligible Entrant himself/herself) as an Arizona “Front Line Hero” who has gone above and beyond to care for individuals in the community who have been affected by the COVID-19 pandemic:

  • Nominee’s name, email address, and phone number;
  • Nominee’s Front Line Hero Category:
    • Hospital Health Care Workers – Any and all hospital workers who care for our Arizonans who need medical care.
    • Non-Hospital Health Care Workers – Employees at assisted living or care facilities, pharmacies, doctor offices, clinics and others. This award is in memory Patrick Saenz, a care manager and valued member of our Blue Cross Blue Shield of Arizona team who was lost to COVID-19 earlier this year.
    • First Responders – People we count on in an emergency such as Police, Fire, EMTs, Military, and National Guard.
    • Educators – Teachers, school assistants, classroom helpers and tutors.
    • Essential Service Workers – Those who make the services we rely on in our daily lives possible in a pandemic such as grocery store employees, delivery drivers, sanitation workers, janitorial staff, food service personnel, and so many others.
    • Volunteers – From helpful neighbors to those who are donating their time to serve others at food pantries, homeless shelters, veterans organizations, and countless other organizations.
  • Answer each of the following questions regarding Nominee (each is assigned a point value for scoring purposes as set forth under the Judging Requirements section below):
    • Why are you nominating this Nominee as an Arizona “Front Line Hero”?
    • What significant contribution has the Nominee made during the COVID-19 pandemic?
    • How has the Nominee gone “above and beyond” in providing service to others during the COVID pandemic?
    • What impact has the Nominee’s actions had on others?
  • Upload at least one (1) Photo or Video that features Nominee in action/service.

Eligible Entrant will also have the ability to (i) submit through the Website up to three (3) images (must be in JPG or PNG format, with a maximum Photo size of 2 MB, and a maximum pixel size (width and height) of 1200 pixels) that features Nominee in action/service (each, a “Photo”); and/or (ii) submit through the Website one (1) original video (between 30 and 45 seconds in length) that features Nominee in action/service (each, a “Video”). Videos must not be larger than [500 MB].  Video files must be in [MOV, MPEG, MPG, MP4, M4V, VOB, FLV, AVI, ASF, DIVX, WMV] format.  Submitting additional Photos or Videos is not required to enter the Contest.  Although a Photo or Video is required, no points are awarded for any Photos or Videos submitted. All Photos and Videos must comply with PHOTO AND VIDEO REQUIREMENTS specified below. Sponsor is not responsible for any entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion, or incompatibility at Sponsor’s servers or elsewhere, which entries are void.  If all required information is not included, entry will be disqualified.

Photo and Video Requirements.  Eligible Entrant must be the sole owner of all right, title and interest in and to the Photos and Videos, or otherwise possess all rights in and permissions to the Photos and Videos required to grant the rights contemplated in these Official Rules to the Sponsor.  If any person whose name, voice, likeness, or persona is referenced, shown or otherwise captured in the Photo or Video, Eligible Entrant must secure the written consent of such person(s), and, if such person(s) are under the age of majority, also such person(s) parent/guardian.  Each Eligible Entrant is solely responsible for obtaining from all applicable individuals, entities, governmental bodies, or other persons (including employers) any and all required rights, releases, consents, clearances, licenses and other authorizations necessary to exploit and otherwise submit the Photo or Video, and use and publish the Photo or Video, including any trademarks, trade dress, logos, copyrighted material or any other intellectual property of any individual, company, or other entity featured therein, in any and all forms of media, including, but not limited to, location releases.  All Photo and Video submissions shall become the sole property of the Sponsor and will not be returned, and Sponsor shall be free to use, copy, disclose, license, distribute and exploit any such Photo and Video in any manner without any obligation, royalty or restriction.  Photos or Videos will not be accepted in the Contest if they include any content that contains or appears to contain, in each case as determined by the Sponsor in its sole discretion, any of the following: (a) offensive, profane, obscene or inappropriate material; (b) endorsement of (or condones) illegal drug use, alcohol abuse, or other illegal activity; (c) nudity, profanity, or extreme or gratuitous violence; (d) any express or implied commercial endorsement; (e) any derogatory characterization of any person or group based on age, race, color, gender, gender identity and expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance, political affiliation, union membership, or other unethical or unlawful factors; (f) depictions of any conduct, language or other context not in keeping with Sponsor’s image; or (g) material that defames or invades publicity rights or the privacy of any person living or deceased, or otherwise infringes upon any person’s personal or property rights or any other third party rights, including, without limitation, trademark, copyright or other intellectual property rights.  Sponsor reserves the right to disqualify any entry it deems to fail to meet the requirements of these Official Rules.  A Photo or Video will not be accepted if it includes any trademarks, trade dress, logos, copyrighted material or any other intellectual property of any individual, company, or other entity or which may imply a false association or sponsorship or violate the intellectual property rights of any third party, unless such third party has consent to such use or implication. Eligible Entrants are solely responsible for any copyright infringement or other violation of law arising from the Sponsor’s use of the Photo or Video.  Entrants acknowledge that any breach or violation of these Official Rules, or a third-party asserting rights to any Photo or Video, shall immediately disqualify the Eligible Entrant during the Contest.  ENTRANTS SHOULD NOT INCLUDE THEIR NAME, CONTACT INFORMATION OR ANY OTHER PERSONALLY IDENTIFIABLE INFORMATION IN THE PHOTO OR VIDEO, OR ANY PART THEREOF, AS THE PHOTOS OR VIDEOS MAY BE PUBLICLY ACCESSIBLE.  SPONSOR RESERVES THE RIGHT TO MODIFY THE PHOTO OR VIDEO TO REMOVE SUCH INFORMATION AND/OR DEEM THE PHOTO OR VIDEO VOID AND INELIGIBLE TO PARTICIPATE IN THE CONTEST.

Warranty.  By entering the Contest, each Eligible Entrant represents, warrants and covenants that (a) each entry is the Eligible Entrant’s original work, is true and correct in all material respects, and does not infringe upon or otherwise violate any right of any third party, including any copyright, trademark or other intellectual property rights; (b) each entry has not been previously published; and (c) the Eligible Entrant has the right and power to enter the Contest and perform all of its obligations.

Ownership/Use Rights.  SUBMISSION OF ENTRIES AND ANY COPYRIGHTED OR COPYRIGHTABLE WORK OR DESIGNS OR OTHER INTELLECTUAL PROPERTY CONTAINED THEREIN, INCLUDING ANY PHOTOS (BUT NOT INCLUDING ANY VIDEOS), IN THIS CONTEST CONSTITUTES ENTRANT’S IRREVOCABLE AND EXCLUSIVE ASSIGNMENT, CONVEYANCE, AND TRANSFERENCE TO SPONSOR OF ALL RIGHT, TITLE, AND INTEREST OF SUCH ENTRIES, INCLUDING ANY PHOTOS (BUT NOT INCLUDING ANY VIDEOS), AND ANY OTHER INTELLECTUAL PROPERTY CONTAINED THEREIN, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS, and the Eligible Entrant agrees that Eligible Entrant (or any other third party) does not retain any rights to such entries or other materials, including Photos (but not including any Videos).  Eligible Entrant agrees to execute such assignment or other documents as are necessary to enforce the rights of the Sponsor granted herein without any compensation of any kind to Eligible Entrant, his/her successors or assigns, or any other entity.  By entering the Contest, the Eligible Entrant agrees that the Sponsor shall have the right, but not the obligation, to edit, remove, modify, publish, license, print, transmit, display or otherwise use any submitted entry, including any Photos or Videos, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation to Eligible Entrant, his/her successors or assigns, or any other entity, except where prohibited by law.  Eligible Entrant waives any retained rights of attribution, privacy, publicity, withdrawal, integrity or other moral or personal rights in the entry and other related materials, including any Photos.  All entries and other submitted materials become the property of the Sponsor and will not be returned to any Eligible Entrant.  If Sponsor requests the Eligible Entrant’s cooperation in promoting the Contest, the Eligible Entrant agrees to reasonably be available for such promotional activities.

Judging Requirements. From on or about November 29, 2020 to December 6, 2020, a committee comprised of up to fifteen (15) Sponsor employees (the “Judging Committee”) will review all eligible entries submitted during the Contest Period and determine the top (5) winning Nominees for each of the six (6) Nominee Front Line Heroes categories (i.e., Health Care Workers (Hospital), Health Care Workers (Non-Hospital), First Responders, Teachers, Essential Service Workers, Volunteers) based on the following criteria:  (a)   authenticity, inspiration and selflessness of Nominee’s story – 80%; (b) clarity and completeness of Contest submission – 20%.

  • Why are you nominating the Nominee as an Arizona “Front Line Hero”? 10 points
  • What significant contribution has the Nominee made during the COVID-19 pandemic? 10 points
  • How has the Nominee gone “above and beyond” in providing service to others during the COVID pandemic? 10 points
  • What impact has the Nominee’s actions had on others? 20 points

By entering the Contest, each Eligible Entrant agrees that the Judging Committee’s decisions regarding the Nominee Winners for each Front Line Hero category and in regard to all related matters (including, without limitation, eligibility) shall be final and binding in all respects.

Winner Notification.  Each potential winning Nominee will be notified by email or by telephone and will be required to execute and return an affidavit of eligibility/liability release and, where lawful, a publicity release (collectively, the “Affidavit/Release”) within fourteen (14) days of date of issuance.  Each winning Nominee is fully responsible for any and all applicable federal, state, and local taxes associated with the Cash Prize. Each winning Nominee understands that the Sponsor or its respective agents may advise the United States Internal Revenue Service of the value of the Cash Prize awarded to Nominee from Nominee’s participation in the Contest in the form of an IRS Form 1099, or otherwise.  Nominee understands that prior to being entitled to receive any Cash Prize, and prior to receiving any Cash Prize, Nominee will be required to first provide Sponsor with all of Nominee’s applicable taxpayer identification information and other required and reasonably requested tax and tax-related documentation (e.g., IRS Form W-9, government-issued photo identification, etc.).  If the winner does not have a SSN/FEIN and therefore cannot provide one on the Affidavit/Release and does not submit a complete and correct Form W-9, the Sponsor will have the right, if required by applicable law, to withhold federal income tax according to applicable federal tax law and submit that withheld amount to the U.S. Treasury on the winner’s behalf, and the winner will receive a Cash Prize that is net of the federal income tax withheld.  If such potential winner declines in writing to accept a Cash Prize, such required information or documents are not returned within the specified time period, Cash Prize or Cash Prize notification is returned as undeliverable, the Sponsor is unable to contact a potential winner within a reasonable time period, or a potential winner is not otherwise in compliance with these Official Rules, the Cash Prize will be forfeited and, at the Sponsor’s sole discretion and time permitting, Sponsor may select as a winner the first runner-up to each winner category based on total points awarded from the applicable Front Line Hero category based on the Judging Committee’s determination.

Prizes.  Top Thirty (30) Winners.  The top five (5) Nominees based on total points awarded by the Judging Committee from each of the six (6) Front Line Hero categories will each be deemed a Contest winner (each, a “Nominee Winner”) and will each receive a grand prize that includes one (1) cash prize in an amount equal to $1,000 (the “Cash Prize”).  Six (6) Grand Prize Winners.  The top Nominee Winner with the highest total points awarded by the Judging Committee from each of the six (6) Front Line Hero categories will also have the ability to nominate an Arizona nonprofit organization exempt from taxation under Section 501(c)(3) of the Internal Revenue Code, as amended, that has gone above and beyond to serve the community during the COVID-19 pandemic (the “Nonprofit Nominee”) to receive a cash donation of $10,000 from Sponsor (the “Nonprofit Donation”). Sponsor has the right to make the final determination regarding which organizations will receive the cash donations including but not limited to having the right, in its sole discretion, to reject any Nonprofit Nominee if the Nonprofit Nominee or the Winner has not complied with these Official Rules or the Nonprofit Nominee’s mission is not consistent with the mission or image of Sponsor.  In the event the Nonprofit Nominee is rejected by Sponsor, the Winner may nominate another eligible Nonprofit Nominee for consideration by Sponsor. The Winner agrees that the Nonprofit Donation cannot fulfill a pledge or other obligation of any person, including but not limited to the Winner nominating the Nonprofit Nominee, and the Winner is prohibited from receiving any consideration from any person (including, but not limited to, the Nonprofit Nominee) in return for the Nonprofit Donation.  For purposes of clarification, the Nonprofit Donation is not considered funds of the Winner at any time and the Winner has no right to or interest in the Nonprofit Donation.  Each Nonprofit Donation constitutes funds made available by Sponsor that may only be used by the Nonprofit Nominee (as approved by Sponsor) to help support the Nonprofit Nominee’s COVID-19 programs or related efforts.  Each potential Nonprofit Nominee will be notified by email or by telephone and will be required to execute and return any required information or documents, as determined appropriate in the sole and absolute discretion of Sponsor, within fourteen (14) days of date of issuance.  If the Nonprofit Nominee declines in writing to accept a Nonprofit Donation or such required information or documents are not returned within the specified time period, the Sponsor is unable to contact a potential Nonprofit Nominee within a reasonable time period, or a potential Nonprofit Nominee is not otherwise in compliance with these Official Rules, the Nonprofit Donation will be forfeited and, at the Sponsor’s sole discretion and time permitting, Sponsor may give the applicable Nominee Winner an opportunity to nominate an alternative Nonprofit Nominee to receive the Nonprofit Donation. If Sponsor does not receive any eligible Nominees for any one of the Front Line Hero Categories, Sponsor will not award a prize for that Front Line Hero category.

All costs and expenses associated with Cash Prize acceptance and use not specified herein are the sole responsibility of the applicable Nominee Winner. Prizes are non-transferable and non-assignable and will be provided only to the Nominee Winner, with no substitutions except at the Sponsor’s sole discretion. There will be no substitutions for any Cash Prize except by the Sponsor who reserves the right to substitute a Cash Prize with one of comparable or greater value at its sole discretion. No interest will be paid on any Cash Prize.  Other restrictions may apply.

Conditions/Use Rights.  By accepting any Cash Prize, each Nominee Winner consents to the use of his/her name and all accompanying personally identifiable information Nominee Winner submits, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation (other than the Cash Prize described herein) to Nominee Winner, his/her/its successors or assigns, or any other entity, except where prohibited by law.

Privacy.  By participating in the Contest, each Eligible Entrant and Nominee Winner authorizes the Sponsor to collect, use, process, transfer and store all data provided by Eligible Entrant or Nominee Winner, including without limitation, personal data, to the United States, or any location(s) throughout the world that the Sponsor deems necessary, whether within Eligible Entrant’s or Nominee Winner’s country of residence or elsewhere, and with such party(ies) as the Sponsor deems appropriate, for purposes of administration of the Contest.  All information submitted to the Sponsor as part of this Contest will be treated in accordance with the Sponsor’s privacy policy, available at https://www.azblue.com/legal/website-privacy. Sponsor will only use Eligible Entrant’s and Nominee Winner’s personal information to: (a) provide information about the Contest; (b) contact and publicize potential winners; and/or (c) if an Eligible Entrant or Nominee Winner selects to receive additional information from the Sponsor, to send additional information to that Eligible Entrant or Nominee Winner during or after the Contest Period.  Eligible Entrants and Nominee Winners may be given the option to receive commercial e-mails from the Sponsor; however, eligibility to participate or win any prize in the Contest is not dependent upon Eligible Entrant’s or Nominee Winner’s consent to receive such e-mails.  Eligible Entrants and Nominee Winners must fully complete and submit all non-optional data the Sponsor requests to be eligible.

Release and Limitations on Liability.  By participating in the Contest, each Eligible Entrant and Nominee Winner agrees, to the extent permitted by law, to release and hold harmless Sponsor and its subsidiaries, affiliates, sales representatives, distributors, licensees, agents, advertising and Contest agencies, and all directors, officers and employees of any of the foregoing entities (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, incorrect, garbled, or incompletely received entries; (e) errors in the administration of the Contest or the processing of entries; (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Eligible Entrant’s or any Nominee’s (including any Nominee Winner’s) participation in the Contest or acceptance, receipt, use, or misuse of any prize; or travel to any Contest-related events; and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, defamation or invasion of privacy and merchandise delivery.  In the event that Eligible Entrant or Nominee Winner breaches any of these Official Rules, Released Parties shall be entitled to and may seek indemnification, to the extent permitted by law, from Eligible Entrant or Nominee Winner for recovery of all legal fees, damages, costs, claims and other expenses that may be incurred by Released Parties as a result of the aforementioned breach.  Eligible Entrant and Nominee Winner further agree to release the Released Parties and their designees and assigns from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses and damages of any kind arising out of or in connection with the Contest or acceptance, possession, or use of any prize (including, without limitation, attorneys’ fees, claims, costs, personal injuries, losses and damages related to personal injuries, death, damage to or destruction or property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.  Sponsor is not responsible if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

Miscellaneous.  The decisions of Sponsor are final with respect to all aspects of this Contest.  The Contest and these Official Rules will be governed, construed and interpreted under the laws of the State of Arizona, without regard to choice of law principles.  Except where prohibited, each Eligible Entrant and Nominee agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the applicable state or federal courts situated in Phoenix, Arizona; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (3) under no circumstances will any Eligible Entrant or Nominee (including any Nominee Winner) be permitted to obtain awards for punitive, incidental, special, consequential or other damages, including without limitation, lost profits.  For purposes of these Official Rules, (a) the words “include,” “includes” and “including” shall be deemed to be followed by the words “without limitation”; (b) the word “or” is not exclusive; and (c) the words “herein,” “hereof,” “hereby,” “hereto,” and “hereunder” refer to these Official Rules as a whole. In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of Sponsor that may cause the Contest to be disrupted or corrupted, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prize from among the non-suspect, eligible entries received up to the time of the impairment.  Sponsor reserves the right in its sole discretion to disqualify any entrant it finds to be tampering with the entry process, the operation of the Contest, to be acting in violation of these Official Rules or any applicable laws relating to the Contest, or in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion.  Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Winners List. For a list of winners in the Contest, send a self-addressed, stamped envelope to BlueCross BlueShield of Arizona, c/o Front Line Heroes Contest, 2444 W Las Palmaritas Dr, Phoenix, AZ 85021, after December 7, 2020, but before June 30, 2021.

Sponsor. The Sponsor of this Contest is BlueCross BlueShield of Arizona, 2444 W Las Palmaritas Dr, Phoenix, AZ 85021.  Eligible Entrants and Nominees shall not use the trademarks of Sponsor or falsely associate themselves with Sponsor during or after the Contest Period.
